Nanosys, Inc. has filed a patent infringement suit against Nanoco Technologies Ltd.

Palo Alto, CA. April 28, 2009 – Nanosys, Inc. has filed a patent infringement suit against Nanoco Technologies Ltd. claiming that the United Kingdom firm’s quantum dot technology infringes five patents held by Nanosys. The suit alleges that Nanoco’s quantum dot materials, which are being distributed in the United States by Sigma Aldrich under the brand name Lumidots, infringes its patents.
The suit was filed in the Federal District Court for the Western District of Wisconsin where Sigma Aldrich maintains a sales office and development and manufacturing facility, and is a court that is known for working on an accelerated timetable and that strictly adheres to deadlines, resulting in speedy disposition of patent cases. Nanosys is currently using its quantum dot technology to produce devices such as solid state lighting, photovoltaics and electronic displays.
Nanosys has asked the court to declare that Nanoco and its American distributor, Sigma Aldrich, are infringing Nanosys’ patents. It also has asked the court to enter a permanent injunction barring Nanoco from selling its quantum dots in the United States, and it has asked for the court to award it triple damages due to alleged willful infringement.
Nanosys has the exclusive rights to over 650 patents and applications covering fundamental aspects of its nanotechnology including its quantum dot technology, and is committed to enforcing its intellectual property, as appropriate, to further its core business interests.
